NARASINGH Order No. ORDER 16.07.2025 01. 1. Heard learned counsel for the Petitioners and learned counsel for the State. 2. The Petitioners are seeking pre-arrest bail in connection with C.T. Case No.63 of 2025 pending in the Court of learned J.M.F.C., Kotagarh, arising out of Kotagarh P.S. Case No.63 of 2025 for commission of offence punishable under Sections 329(4)/ 303(2)/ 324(5) and 3(5) of BNS, 2023. 3. It is submitted by the learned counsel that Petitioners were before this Court in ABLAPL No.5764 of 2025. By order dated 20.05.2025, they were directed to be released on bail subject to verification of not more than one criminal antecedent of similar nature. 4. Subsequently, it came to fore that the Petitioners have also been implicated, in addition to the offence as above, under Section 324(5) of the BNS. The same is bailable offence. 5. Taking note of the same and keeping in view the nature of allegations, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioners shall be released on bail by the learned Court in seisin on such terms as deemed just and proper subject to verification of criminal antecedent of similar nature. 6. If it comes to fore that the Petitioners have more than one criminal antecedent of similar nature, this order shall not be given effect to. 7. Before releasing the learned Court shall verify as to whether this order has been assailed before the Apex Court and if so, the result thereof. 8.
