Neutral Citation No. - 2025:AHC:80517-DB Court No. - 29 Case :- WRIT - C No. - 12170 of 2025 Petitioner :- Jai Shankar Singh Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Aruna Singh,Dolly Dwivedi Counsel for Respondent :- J. N. Maurya,Anuj Pratap Singh,C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J.
1. Heard Ms. Dolly Dwivedi, learned Counsel for the appellant and Mr. Shiv Prakash Gupta, learned counsel holding brief of Mr. J.N. Maurya, learned counsel for the respondent.
2. This writ petition has been filed with a grievance that though plot No. C-486 was allotted to the writ petitioner by UPSIDC in 2017, but its possession is not being given to the petitioner. It is alleged that various representations made in this regard have not been bestowed any consideration.
3. Learned counsel for the respondent, on the basis of instructions, submits that the aforesaid plot is still available on the spot and, if the petitioner takes necessary steps to get the lease deed executed, the authority will ensure delivery of possession of plot to the petitioner.
4. In the event, the plot petitioner allotted to the petitioner is available and the authority is willing to deliver its possession, we see no reason as to why petitioner's prayer for allotment of alternative plot be directed to be considered.
5. In that view of the matter, we dispose of this writ petition permitting the petitioner to approach respondent No.3 for the purposes of getting the lease deed executed. If the petitioner does so, the respondent authority shall ensure that the lease deed is executed forthwith and the vacant physical possession of the plot be handed over to the petitioner.
6. Required steps in terms of the above observation would be taken within a period of two months from the date of presentation of a copy of this order. Order Date :- 15.5.2025 DKS Digitally signed by :- DEEPAK KUMAR SRIVASTWA High Court of Judicature at Allahabad
