JUSTICE V.SRISHANANDA) 1. Learned counsel for the revision petitioner has filed memo. Memo is acknowledged by the learned counsel for the respondent. Memo reads as under: “The joint settlement memo on behalf of the petitioner and respondent is as under: 1. The Petitioner and respondent have jointly agreed to settle the top noted case for Rs.6,00,000/- (Rupees six lakhs only). 2. The Petitioner has already deposited an amount of Rs.3,80,000/- before the trial Court as per the decision of this Court. The respondent is at liberty to withdraw the same forthwith. 3. The remaining balance of Rs. *2,20,000/- shall be paid by the petitioner before 14.06.2025 in two installments. The 1st installments of Rs. 1,10,000/- shall be paid on or before 30.04.2025 and balance amount of Rs. 1,10,000/- shall be paid on or before 14.06.2025. Failing which the respondent shall be *Corrected Vide order dated 25.04.2025 Sd/- (VSNJ) JUDGE - 3 - NC: 2025:KHC-D:5818 CRL.RP No. 100204 of 2023 liberty to execute the trial Court order in C.C.No.540/2020. 4. The parties have entered into settlement without any coercion. Hence this Joint memo. ” 2. Placing the memo on record, revision petition stands disposed off. 3. With the above settlement, respondent agrees to withdraw all other pending proceedings against the revision petitioner in respect of the present transaction. 4. It is made clear that if the agreed amount of compensation if not paid, order of the trial Magistrate confirmed by the First Appellate Court stands restored automatically. 5. After the payment of entire agreed compensation amount, fine amount of Rs.2,000/- imposed by the trial - 4 - NC: 2025:KHC-D:5818 CRL.RP No. 100204 of 2023 Magistrate to be appropriated towards the defraying expenses of the State stands set aside. 6.
