2. The petitioner seeks bail in a case registered for the offence punishable under Sections 30(a), 33 and 36 of the Bihar Prohibition and Excise Amendment Act, 2022.
3. Perusal of the first information report and the seizure list would go to show that total 840 liters of spirit and 89.100 liters of country made liquor is said to have been recov- ered from a room of the boring of the Irrigation Department.
4. It is submitted by learned counsel for the petitioner that the police has reached the place of occurrence on a secret information and the petitioner is no way connected with this oc- currence. The petitioner is neither employee of the Irrigation Department nor the owner of the said boring or any way con-

Moreover, the place of recovery is an open place and easily accessible to anyone, hence the peti- tioner cannot be imputed with the said allegation. No recovery has been made from the conscious or physical possession of the petitioner and there is no independent witness to the said seizure violating the mandatory provisions of search and seizure. Peti- tioner has no criminal antecedent and has been languishing in custody since 10.04.2025.

Taking into consideration the fact and circum- stances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pend- ing/successor Court in connection with Barun P.S. Case No.192 of 2025.
