PUBLIC PROSECUTOR The Court made the following order: This Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner herein/A1, seeking anticipatory bail, in connection with Crime No.265 of 2024 of Mangalagiri Rural Police Station, Guntur district. 2 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 376(2)(n), 506, 509 and 354-D read with 34 IPC and Sections 67-A, 66-E and 67 of the Information Technology Act, 2000-2008. 3. Case of the prosecution, in brief, is that, prior to 25.05.2024, the petitioner herein/A1, who is brother-in-law of the de facto complainant/victim and husband of her elder sister, is alleged to have committed aggravated penetrative rape repeatedly on the de facto complainant/victim. It is also alleged that the petitioner/A1 morphed the photos of the victim and posted them on facebook, instagram, whatsapp etc, thereby defamed her. 4. Heard. Perused the record. 5. A perusal of the material on record, prima facie, goes to show that very serious accusations are attributed against the petitioner herein/A1 alleging that he committed aggravated penetrative rape repeatedly on the de facto complainant/victim and he morphed her photos and posted them on facebook, instagram, whatsapp etc. Learned Assistant Public Prosecutor 3 submitted that the investigation is at nascent stage and some more witnesses are to be examined. 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner/A1. 7. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed. _______________________ K.
