The petitioner has been made accused in connection with Harla P.S. Case No. 165 of 2023, for the offences registered under Sections 307, 326/34 of the Indian Penal Code and Sections 25(1-B)(a)/27 of the Arms Act, pending in the court of Sri Akshay Sharma, learned Judicial Magistrate, 1st class, Bokaro. On 11.11.2023 at about 07:30 A.M, unknown persons are said to have fired upon the informant, due to which, he sustained firearm injuries. It was submitted that petitioner is neither named in the F.I.R. nor he was put on T.I. Parade. It was further submitted that name of the petitioner has transpired in the confession of co-accused. On perusal of the impugned order, it appears that the name of the petitioner has come on the basis of confession of co-accused Rajendra Prasad Dubey and the petitioner has also confessed his guilt. Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact. Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Akshay Sharma, learned Judicial Magistrate, 1st class, Bokaro, or his successor, in connection with Harla P.S.
