The Writ Petition No.12123 of 2014 is filed under Article 226 of the Constitution of India seeking the following relief:-

“….to issue a writ or direction or order, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 4 in seeking to dispossess the petitioner from an extent of Ac.431.81 cents of dry land comprised in Sy.No.339 situated at Gundavolu Village of Rapur Mandal, SPSR Nellore District as illegal, arbitrary, unjust and in violation of Articles 14, 21 and 300A of Constitution of India principles of natural justice, G.O.Ms.No.533, dt.8.10.2013 of the 1st respondent and consequently direct the respondents 2 to 4 not to dispossess the petitioner from the above said land and pass such other orders…”
4. The Writ Petition No.33277 of 2015 is filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate writ or direction or order, more particularly one in the nature of Writ of Mandamus declaring the action of respondents 2 to 8 in seeking to dispossess the petitioner and its Directors from an extent of Ac.431-81 cents of dry land comprised in Sy.No.339 situated at Gundavolu village of Rapur Mandal, SPSR Nellore District as illegal, arbitrary, unjust and in violation of Articles 14 21 and 300A of the Constitution of India principles of natural justice G.O.Ms.No.533 dt.08.10.2013 and consequently direct the respondents not to dispossess the petitioner from the above said lands without following due process of law and to pass such other orders…”

The petitioners in writ petition Nos.12123 of 2014 and 33277 of 2015 is a company, who became the absolute owner of an extent of Ac.431.88 cents of dry land comprised in Sy.No.339 situated in Gundavolu village of Rapur Mandal, SPSR Nellore District, vide different registered sale deeds pertaining to years 1997-99 for valid consideration. The petitioners developed the said land by raising Mango garden in the said extent by spending huge amounts. The petitioner company initially

filed an application under Section 18 (2) of the A.P.Lands Reforms (Ceiling on Agricultural Holdings) Act, 1973 seeking exemption of the above said lands as the said lands were acquired by the petitioner for non-agricultural purpose.
Considering the request made by the company, Government issued G.O.Ms.No.533 Revenue (Land Reforms) Department dated 08.10.2013 exempting the land measuring Ac.431.81 cents situated at Sy.No.339, Gundavolu village, Rapur Mandal, Nellore District from the provisions of Section 18 (1) of A.P.Land Reforms (COAH) Act, 1973 in favour of SFR Resorts Pvt. Ltd., Nellore for development of Tourism. 6. While so, when respondent Nos.2 to 5, with the assistance of respondent Nos.6 to 8, are proceeding hastily and illegally with the development of the land belonging to the petitioner company, having been in possession of the subject land by virtue of G.O.Ms.No.533 dated 08.10.2013, they were constrained to file W.P.Nos. 12123 of 2014 and 33277 of 2015 requesting this Court to direct the respondents not to interfere with their possession in the light of G.O.Ms.No.533 dated
08.10.2013. 7. With regard to W.P.Nos.16192 of 2012 and 38001 of 2013, they were filed by farmers contending that they are the owners of the land in an extent about Ac.473.68 cents situated in Survey No.339(1) and an extent of 60-00 Acres in Survey No.339(1)(b) of Gundavolu village of

Rapur Mandal, Nellore District having acquired the same through their ancestors, whose names also reflected in the revenue records. When the respondents are trying to interfere with the possession of the petitioners under the guise of G.O.Ms.No.533 dated 08.10.2013 issued by the Government in favour of the petitioners in W.P.No.12123 of 2014 and 33277 of 2015, the farmers filed W.P.No.16192 of 2012 and 38001 of 2013 requesting this Court to direct the respondents not to interfere with their possession. 8. When W.P.No.16192 of 2012 came up for admission, this Court passed the following interim order on 24.01.2017:
“Status quo prevailing as on date shall be maintained in all respects by both parties.”

When the matter came up for hearing, learned counsel for the petitioners in all these four writ petitions as well as learned Government Pleader for the respondents, submitted that a civil dispute is pending between the parties vide O.S.No.118 of 2008 on the file of the Principal District Judge, Nellore and all the petitioners in the above writ petitions are maintaining status quo in view of the interim order granted by this Court on 24.01.2017. 10. Learned Assistant Government Pleader for Revenue has furnished copy of the instructions received from the Tahsildar, Rapur Mandal dated 01.09.2025, wherein it is specifically stated as follows:

“One Sri Nuthalapati Rama Subba Naidu and 12 others have filed O.S.No.118 of 2008 on the file of Hon’ble Prl. District Judge Court, Nellore declaring the title possession of land Ac.473.68 in Sy.No.339 of Gundavolu Village, the same is pending adjudication before the Hon’ble Court.”

In view of the fact the petitioners in W.P.No.16192 of 2012 and W.P.No.38001 of 2013 filed O.S.No.118 of 2008 against the petitioners in W.P.No.12123 of 2014 and 33277 of 2015 and the same is pending adjudication, without going into the merits of the case, these writ petitions are disposed of directing all the writ petitioners in W.P.Nos.12123 of 2014, 33277 of 2015, 16192 of 2012, 38001 of 2013 to maintain status quo. However, their possession shall be subject to the result in O.S.No.118 of 2008 on the file of the Principal District Judge, Nellore. No costs.
