2 well as Mr. Shashank Thakur, learned Deputy Advocate General, appearing for the State/respondent Nos. 1 to 4.
2. The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking following reliefs :-
“10.1. The Hon'ble Court may kindly be pleased to call for the records of the instant case.
10.2. That, this Hon'ble Court may kindly be pleased
order any appropriate Writ/Writ(s), Direction/ Direction(s) to set aside the Work Order dated 07.08.2025 issued by the Respondent No. 3 in favour of the Respondent No. 5 being arbitrary and illegal and against the rules of the State of Chhattisgarh.
10.3. The Hon'ble Court may kindly be pleased to grant any other relief(s) and/or direction(s) as deemed just and proper in the facts and circumstances of the case, including a direction to set aside the entire tender process initiated pursuant to NIT No. PU/A/Balod/R.Ni./MT/1335/2025 dated 30.06.2025 by the Respondent No. 3 on the ground that the same is arbitrary, discriminatory, and in violation of the rules and guidelines framed by the State of Chhattisgarh governing public procurement.
10.4. The Hon'ble Court may kindly be pleased to grant any other relief(s) and/or direction(s) as deemed just and proper in the facts and circumstances of the case, including a direction to Respondent No. 3 to initiate a fresh Notice Inviting Tender (NIT) for the purpose of obtaining vehicles for VIP duty, in accordance with law and in the interest of justice and fairness.
10.5. Award cost of proceedings in favour of the Petitioner.”
3. From perusal of the prayers and pleadings made in the instant writ petition, it transpires that the petitioner had already participated in the tender in question and he was disqualified and in the instant
3 petitioner, the petitioner has not challenged his disqualification despite he has challenged the entire tender process.
4. In that view of the matter, we do not find any good ground for interference in the present matter, accordingly, the instant petition is dismissed. However, if the petitioner is aggrieved by his disqualification, he is at liberty to take recourse to law. Sd/- Sd/- (Bibhu Datta Guru)
