V The above writ petition is filed to declare the action of the 2"'"^ respondent in not issuing a passport, in pursuance of the application made by the petitioners, vide File Nos.VS5077467937325 and VS5077490131125 due to pendency of a criminal case in C.C.no.1568 of 2023 on the file of Special Mobile Judicial First Class Magistrate, Kakinada, as illegal and arbitrary. 2. 3. Learned counsel for the petitioner would submit that the petitioners, who are wife and husband, applied for passports before the 2'"'' respondent. The 2'''^ respondent issued two notices dated 20.03.2025 seeking clarification due 2 to the adverse police verification report. Learned counsei would further submit that mere pendency of a criminal case is not a bar to the issuance of a passport. 3. Learned counsel appeared for the respondents would submit that the petitioners are Accused Nos 1 and 2 in Crime No.290/2023 of Sarpavaram Police Station for the offences punishable under Sections 448, 324, 323, 506 r/w 34 of IPC. The police filed the same is numbered as C.C.No.1568/2023 In reply, learned counsel for the petitioners will approach the jurisdictional a final report before the jurisdictional Court , and 4. petitioners would submit that the court and make applications. 5. Given the facts and cicircumstances of the case, the writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, giving liberty to the petitioner to C.C.No.1568/2023 make an appropriate application in on the file of the Special Mobile Magistrate, Kakinada. If the petitioners Judicial First Class make such an application, the learned and pass appropriate orders Magistrate shall consider the application expeditiously as possible, keeping i by specifying the period.
