THE HON’BLE SRI JUSTICE HARINATH.N ( CRIMINAL PETITION No.2975 OF 2025
ORDER:
1. Heard the learned counsel for the petitioner.
2. The petitioner is aggrieved by the order, dated 01.11.2024, passed in Cri.M.P.No.3468 of 2024 in C.C. No.1083 of 2021, by the Special Magistrate, Tanuku.
3. The petitioner filed CrI.M.P. No.3468 of 2024 under Section 311 of the Code of Criminal Procedure, 1973, seeking to send Ex.P.1, the promissory note, Ex.P.5, the acknowledgment card, along with the admitted signature on Ex.P.2, the cheque, to a handwriting expert to ascertain the genuineness of the signatures on them. The learned Magistrate dismissed the petition, observing that the application was filed at the arguments stage despite the petitioner being given 20 adjournments to adduce evidence and argue the matter. The learned Magistrate further observed that the request to send documents, including Ex.P.2-cheque, for expert opinion was an attempt to delay proceedings.
4. Upon perusal of the impugned
order, this Court finds no grounds to interfere with the findings of the learned Magistrate. Accordingly, the criminal petition is dismissed.
5. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
