The captioned Writ Petition is filed seeking a Writ of Certiorari to quash the order dated 05/03/2024 passed by respondent No.2 vide Annexure-H. 3. The petitioner contends that he is a Class-I Civil Contractor and was a successful bidder and was awarded a contract on 19.05.2023. The Government contends that despite the work order, the petitioner failed to execute the work. Hence, they were constrained to issue notices one after the other i.e., on 08.11.2023, 20.11.2023 and 07.12.2023 and final notice on 13.12.2023. The Panchanama was also conducted. However, the petitioner failed to co-operate with the same. Hence, they were constrained to terminate the contract by order dated 05.03.2024. Under these circumstances, the petitioner is before this Court. - 3 - NC: 2025:KHC-D:5800 WP No. 102124 of 2024 4. Counsel for the respective parties urged several contentions. Heard the arguments and perused the writ papers with care. 5. The short controversy is about the termination of contract. Despite issuance of notices, the petitioner did not co- operate. Moreover, there is an arbitration clause under the agreement. If at all the petitioner has any grievance about the cancellation of the tender, he is at liberty to agitate his grievance by invoking the arbitration clause in accordance with law, if so advised. 6.
