After arguing for sometime, the parties have agreed before me that the impugned order dated 7th December, 2023 passed by the District Collector, Palghar be set aside, so also the order passed by the Sub-Divisional Officer (“SDO”), Palghar dated 23rd December, 2022 be set aside and the matter be remitted back to the SDO, Palghar. 7th SEPTEMBER, 2026 Gitalaxmi 19-WP-9339-2025.docx 3. In view of the same, the impugned review order dated 7th December, 2023 passed by the District Collector, Palghar is set aside, so also the order passed by the Sub-Divisional Officer (“SDO”), Palghar dated 23rd December, 2022 is set aside and the matter is remitted back to the SDO, Palghar to reconsider the Review Petition. 4. Proceedings mentioned at Page 95 of the paper-book stands restored to the file of SDO. However, the SDO to permit the Petitioner to intervene. The Petitioner would also be made a party to the proceedings, as any order passed by the SDO would have direct bearing on the rights of Petitioner. 5. With the above observations, Writ Petition stands disposed of. 6. All contentions of the parties, including the issue of jurisdiction to entertain review, are left open. [ ARUN R.
