It is brought to the notice of this Court by the learned counsel appearing for both sides on record that the petitioner in the present Interlocutory Application i.e., the respondent in Tr.C.M.P.No.224 of 2025 is an employee in the Postal Department and is currently working at Vijayawada. Learned counsel for the petitioner herein has represented that by virtue of the orders dated 01.09.2025, passed by this Court in Tr.C.M.P.No.224 of 2025, the case in F.C.O.P.No.789 of 2023 has been withdrawn from the Judge, Family Court, Guntur, Guntur District and transferred to the Senior Civil Judge Court at Avanigadda, Krishna District and as such the petitioner herein has to apply for leave to travel from Vijayawada for attending the Court proceedings in F.C.O.P.No.789 of 2023, pending before the learned Senior Civil Judge Court at Avanigadda, Krishna District and as such requested this Court to dispense with the personal appearance of the petitioner herein i.e., the petitioner in F.C.O.P.No.789 of 2023 b'efore the transferee Court/learned Senior Civil Judge Court at Avanigadda, Krishna District. On considering the submissions made by the learned counsel appearing for both sides, this Court feels it is desirable to dispense with the 2. 3. 2 personal appearance of the petitioner herein i F.C.O.P.No.789 of 2023 before the transferee Judge Court at Avanigadda, Krishna District. 4. Later the learned Senior Civil Judge Court at Avanigadda, Krishna District, is directed not to insist for the personal Appearance of the petitioner in F.C.O.P.No.789 of 2023, as long as his counsel is attending the Court proceedings and representing the case except on the day when re-conciliation proceedings are being taken up or on the day when his required to be recorded or on any other day when his personal l e., the petitioner in Court/learned Senior Civil cross-examination is appearance is required as directed by the learned Senior Civil Judge Court at Avanigadda, Krishna District. 5. With the above observations, I.A.No.3 of 2025 is allowed.
