V SURENDRA REDDY (SC FOR PCB) The Court made the following: ORDER: The relief sought in the writ petition is for issuance of Mandamus to declare the action of the respondents in proposing to consider the application 2 of the respondent No.8 for excavation of Mining Limestone of 0.331 Million Tones per Acre in the land admeasuring 124.33 Hectares in Sy.Nos.20, 28, 38, 39, 41, 42 etc., in Ravirala Limestone Mine, Ravirala Village, Jaggaiahpet Mandal, NTR District without resolving the Air and Water pollution problems in the locality. 2. Heard the learned counsel for the petitioner, learned Standing Counsel for the Pollution Control Board, learned Assistant Government Pleader for Revenue for the respondent Nos.3 & 4, learned Assistant Government Pleader for Mines and Geology and the learned Standing Counsel for the 6th respondent. 3. The grievance of the petitioner is against grant of permission for excavation of mining limestone, in favour of the unofficial respondent, in respect of the subject property. 4. When the matter is taken up for hearing today, the learned Standing Counsel for the Pollution Control Board has placed before the Court a copy of instructions received by him from the 2nd respondent. Wherein it is stated that the unofficial respondent has proposed new limestone mining, at Ravirala over an extent of 124.33 Hectares of land. For obtaining the said license it is stated that the required environmental clearances are required to be obtained by the unofficial respondent. In connection thereto a public hearing was conducted on 08-08-2023 to facilitate the general public to express their grievances and the objections. A notice of public hearing was 3 also published in daily news papers. It is stated that the petitioner did not express any concerns at the said public hearing. It is further stated that the unofficial respondent has not yet obtained Environmental Clearance from MoEF & CC and the same is under process. On receipt of the Environmental Clearance the industry has to obtain the Consent to Establish and Consent to operate from the Board for carrying out mining operations for the proposed lime stone mining. 5. The said instructions of the Pollution Control Board are placed on record. 6. In view of the foregoing, the Writ Petition is disposed of. There shall be no order as to costs.
