5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The FIR is delayed by about two days and was instituted against unknown person. The name of the applicant has come up in the statement of the victim recorded under Sections 180 and 183 B.N.S.S. and she seems to be a consenting party as per that statement. She has gone with the applicant to several places, although she has stated that the corporeal relationship was established sometimes by her will and other times by force.
6. Learned counsel for the applicant has further argued that there is no medical corroboration of the incident. The victim is 17 years old as per FIR. It is a matter of consensual relationship as the applicant is also a youth aged about 18 years as his date of birth is 24.07.2006 as per high-school certificate. The criminal history of one case assigned to the applicant stands explained. The applicant is languishing in jail since 19.3.2025 and he is ready to cooperate

submissions made by learned counsel for the parties, the evidence on record, taking into consideration the delay in institution of the FIR and the fact that the victim seems to be a consenting party, and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
10. If in the opinion of the Trial Court absence of the applicant is deliberate or without sufficient cause, then it shall be open for the Trial Court to treat such default as abuse of liberty of bail and proceed against him in accordance with law.
11. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
12. It is made clear that observations made in granting bail to the applicant shall not in any way affect the learned trial Judge in forming his independent opinion based on the testimony of the witnesses.
