Quash the F.I.R. dated 07.06.2025 bearing Crime No. 33/2025, P.S. Mahila Thana, District Durg and subsequent proceedings which lead to filing of the final report/Chargesheet dated 11.08.2025 for the alleged offences under Section 85 read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023 (ANNEXURE P-3); ii. Quash the order dated 20.08.2025 passed by the Learned Judicial Magistrate First Class, Durg, i.e. the order taking cognizance of the alleged offences which have been registered against the present Applicant under Section 85 read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023 in the Criminal Case No. RCC/25320/2025; iii. Quash the entire criminal proceedings of Criminal Case No. RCC/25320/2025 pending before the Learned Judicial Magistrate First Class, Durg, Chhattisgarh which has been registered pursuant to the order dated 20.08.2025 passed by the Learned Judicial Magistrate First Class, Durg, District - Durg, Chhattisgarh. iv. Any other relief/relief(s) which this Hon'ble Court deems fit for the adjudication of the instant matter in the interest of justice.” 3. Learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh after 3 impleading the husband of respondent No.2, so that the matter may be referred to mediation, as the dispute arises out of matrimonial issues. 4. Learned counsel for the State has no objection. 5. Accordingly, the writ petition is dismissed as withdrawn with the aforesaid liberty, as prayed for in favour of the petitioner. 6. The certified copy of the impugned FIR, Charge-sheet as well as the other documents filed along with the annexures be returned to the petitioner after retaining photocopies thereof on record.
