GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondent no.3 in taking steps to register the criminal case pursuant to letter addressed by 2 the 5th respondent vide ROC no.04/C1/2019 Dt.31.10.2019 without concluding departmental Enquiry against the petitioner for the alleged irregularities while executing works in Mydakur Municipality as illegal,arbitrary and unconstitutional and violative of Article 21 and 300-A of Constitution of India and consequently direct the 3rd respondent not to take any further steps pursuant to letter addressed by the 5th respondent vide ROC no.04/C1/2019 Dt.31.10.2019, till the disposal of the Writ Petition.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the letter addressed by Respondent No.5 vide Roc.No.04/C1/2019, dated 31.10.2019, a case in Crime No.79 of 2022 on the file of Mydukur Urban Police Station, YSR Kadapa District for the offences under Sections 120-B, 420 and 409 read with 34 IPC has been registered against the Petitioner herein and others. 3. Sri Polanki Anand Surya, learned counsel for the Petitioner would submit that the Police may be directed to follow due process of law with regard to the crime registered against the Petitioner. 4. In that view, the Writ Petition is disposed of. However, Police are directed to follow due process of law regarding the crime registered against the Petitioner. There shall be no order as to costs.
