1. Through the instant writ petition filed under Article 226/227 of the Constitution of India, a challenge is thrown to the letter dated 03.01.2025 (Annexure P-14), whereby, the application of the present petitioner for registration of the decree dated 14.12.2023 (Annexure P-2), passed in RSA bearing No.6248-2018, for the purpose of transfer of half share in the name of the present petitioner in terms of the said decree, has been declined.
2. During the course of arguments, this Court has put a specific query to learned counsel for the petitioner, as to whether, any execution application has been filed by the petitioner, for the purpose of execution DHARAM VIR 2025.04.23 15:17 I attest to the accuracy and integrity of this document
CWP-10729-2025 -2- of the decree (supra), to which he fairly concedes and answered in 'negative'
3. Therefore, at this stage, this Court is not inclined to grant the asked for relief to the present petitioner, instead, prefers to relegate her to the executing court concerned, for redressal of her grievance.
4. Faced with the above situation, learned counsel for the petitioner submits that he does not want to press the instant petition, at this stage, with liberty to take the remedy in accordance with law.
5. Dismissed, as not pressed, at this stage, with liberty to approach the executing court concerned.
