NASH WAN I KUMAR 3.S ARIFULLAH (SC FOR AP WAQF BOARD) The Court made the following: :: ORDER :: The above writ petition is filed to declare the inaction of respondent authorities in initiating action as per the provision of Waqf Act, 1995 (hereinafter referred to as ‘the Act’) under Section 52A of the Act against the respondents 5 & 6, despite report submitted by respondent No.4 vide F.No.56/Waqf/DIN/Madarsa/2016, dated 10.02.2017 (Ex.P4), is illegal and arbitrary. Page 2 of 3 Heard Sri S.M. Subhani, learned counsel for the petitioner and Sri Shaik Khaja Basha, learned Standign Counsel appeared for respondents 3 & 4 and Sri N. Ashwani Kumar, learned counsel appeared for respondents 5 & 6. 2. At the hearing, Sri Shaik Khaja Basha, learned Standing Counsel would submit that pending the writ petition, the Waqf Board has taken the control of the property of an extent of Ac.1.91 cents in Sy.No.66/6 of Gajuwaka, Visakhapatnam vide Muntakhab in F.No.B3/33/VSP/2005-ZV, dated 24.05.2007 at S.No.4 in Page No.152, registered under Section 36 of the Act. In fact, in the counter affidavit, at para No.7, it was pleaded that the Waqf Board came to know about the mismanagement of respondent 5 & 6 in April, 2016 and a report was called for from respondent No.4, by issuing memo dated 08.04.2016. Respondent No.4, in turn, submitted a report and initiated action. 3. In view of the averment made in the counter affidavit, the grievance of the petitioner that respondents 3 & 4 are not initiating action stands resolved. Hence, the cause in the writ petition does not survive for adjudication. 4. Given the facts and circumstances of the case, the Writ Petition is 5. closed. No order as to costs.
