Heard the parties
1. The petitioners have been made accused in connection with N.D.P.S. Case No. 18 of 2024 arising out of Kasmar P.S. Case No. 89 of 2024, for the offences registered under Sections 20(b), 22, 25 of the N.D.P.S. Act, 1985, pending in the Court of learned Additional District Sessions Judge-II, Bokaro.
2. On 29.10.2024, at about 03:10 p.m., Kasmar Police intercepted motorcycles bearing Registration No. JH09AD 2943 and JH09BE 1643 from a place near Jinargarh Bridge on Ormo-Dantu Road and apprehended both these petitioners. On search, 01 kg of cannabis each were recovered from their possession.
3. It was submitted that the quantum of seized cannabis comes within the purview of intermediary quantity. It was further submitted that the petitioners have got no criminal antecedent and this fact has been mentioned at Paragraph-22 of this Bail Application.
4. Mr. Bhola Nath Ojha, learned Special P.P. has opposed the prayer for bail, but does not dispute the aforesaid facts.
5. In view of the submissions made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are
directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional District Sessions Judge-II,
Bokaro in connection with N.D.P.S. Case No. 18 of 2024 arising out of Kasmar P.S. Case No. 89 of 2024.
