HARPREET SINGH BRAR, J. (ORAL) The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking issuance of directions to respondents No.2 & 3 to ensure a fair and impartial investigation in case bearing FIR No.106 dated 30.04.2020 under Sections 302/201/34 of IPC registered at Police Station City Batala (Annexure P-1). The learned State counsel, at the very outset, submits that the veracity of the allegations made by the complainant has been examined and on the basis of the viscera report and histopathology report, the opinion of the Doctor was obtained and the categoric opinion with regard to the cause of the death is heart attack, as such, the father of the petitioner has died a natural death and after conclusion of the investigation, a cancellation report was filed before the jurisdictional Court. The jurisdictional Court vide order dated 23.09.2024 has not accepted the cancellation report and directed further investigation. The Investigating Agency has complied with the order passed by the jurisdictional Court and is further investigating the case and after Neha 2025.04.08 18:24 I attest to the accuracy and integrity of this document
CRM-M-19427-2025 -2- conclusion of the investigation, the report would be submitted before the jurisdictional Court within a period of three months. In view of the specific stand taken by the learned State counsel, no further directions are required to be passed in the present petition. However, the jurisdictional Court is directed to consider the report filed by the Investigating Agency and pass an appropriate order strictly in accordance with the judgment of this Court passed in ‘Pawan Kharbanda Vs. State of Punjab and another’ CRM-M-3193 of 2015 (O&M) decided on
29.01.2025. The present petition is disposed of accordingly.
