Heard Mr. Anchal Kumar Matre through Video Conferencing and Mr. Purnchand, learned counsel for the petitioner as well as Mr.Sangharsh Pandey, learned Government Advocate, appearing for the State/respondent Nos. 1 & 2. 2. The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking following reliefs :-
“10.1 A writ and/or an order or a direction for respondents to produce the wife of petitioner/Resp. no. 6-Chetna Yadav (Navrang), Aged About 24 Years W/o Ajeet Kumar Navrang, D/o Basant Kumar Yadav, R/o Bahtarai Road, Ward No. 49, B.R. Yadav Nagar, Behtarai Road, P.S. Sarkanda, Dist.- Bilaspur (C.G.) (Corpus) before this Hon'ble High Court. 10.2 A writ and/or an order or a direction for respondents to release the above stated corpus from illegal custody and allow her to make a free and independent choice regarding her residence and safety as well as safety of the child in womb of the wife of petitioner.
10.3 A writ and/or an order or a direction not to harass the petitioner and his family and not to disturb the matrimonial life of the petitioner. 10.4 Any other reliefs, which Hon'ble Court may deem fit in the facts and circumstances of the case. 10.5 Cost of the petition may also be awarded.”
3. Learned State counsel has produced a copy of statement of the corpus Chetna Yadav, D/o Basant Kumar Yadav, private respondent No.6, which was recorded before the Sub-Divisional
3 Officer, Gharghoda, District – Raigar (C.G.) on 08.09.2025 and a copy of the same has also been handed over by the learned State counsel to Mr. Purnchand, learned counsel for the petitioner, whereby she has stated that though she was having relationship with the petitioner, but has taken a decision of her own sweet will that she does not want to live with the petitioner and she has further stated that she is living with her parents of her own sweet will. 4. In view of above, the present habeas corpus is dismissed. 5. This Court was intended to impose a heavy cost on the petitioner for filing the present petition misleading this Court as there is no authorization of the corpus for filing the present petition that she is being illegally detained by her parents, but on the request being made by learned counsel for the petitioner, we refrain to do so.
