The petition coming on for hearing, upon perusing the petition and the grounds filed in support thereof and upon hearing the arguments of Sri K.Pridhvi Raju, Advocate for the Petitioner and of Public Prosecutor for Respondent, the Court made the following
ORDER: Jr THE HONJBLE SRI JUSTICE I.MALLIKARJUNA RAO CRIMINAL PET[T[ON No.3859 of 2025 This C'riminal Petition under Sections 480 and 483 of B.N.S.S., has been filed by the petitioner/A3, seeking regular bail in Cr.No.41/2O24 of Munchingput Police Station, ASR District. 2. The above said crime was registered against the Petitioner/A3 herein and others for the offence punishable u/See.20(b)(ii)(C), 25 r/w 8(c) of the NDPS Act. 3. Case of the prosecution, in brief, isthat, On 26.10.2024 at.about4.00 pm, on receipt of credible information with regard to illegal possess'lon and transportation of ganja, the Sub-Inspector of Police, along with his staff rushed to Labburu village of Jolaput Panchayat and conducting vehicle checking. They found a bike bearing registration nO.OD 18 K 0139 coming towards them. polllce stopped the bike and checking the bike, in the meantime one auto bearing registration no.OD 30 F 1059 following the bike and when the inmates in the auto saw the police, they stopped the auto and tried to escape. Then police apprehended the inmates in the - auto and on enquiry, they disclosed the'lr identity particulars. PoI'lce found 100 kgs of ganja in their possession.
They were arrested and remanded to court for jud'lcial custody and the contraband and auto were seized. *-~~ rrif? Jr/

Learned counsel for the petitioner contended that the petitioner is in judicial custody from 26.10.2024 and most-of the investigation is completed and after expiry of statutory period, police have not filed charge sheet, as such the petitioner is entitled for statutory bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filing of charge sheet by the police even after statutory period is completed, but opposed to grant bail. He further submi{t,ed that no antecedents are reported against the petitioner. 6. Heard both sides. 7. Given that the petitioner has been in remand since 26,10.2024, this Court views that most of the investigation concerning the role of the petitioner in the commission of the offence has likely been concluded. It has been submitted that the petitioner is a permanent resident of Champut Village, ASR District and there is no credible apprehension of his fleeing away from justice. Since most of the witnesses are official, the release of the petitioner would not impede the investigation or tamper with the evidence and also after completion of statutory period, police have not filed charge sheet and also they have not filed any petition for extension of time for investigation. In view of seizure- of huge quantity of contraband, imposing stringent conditions would meet the ends of justice, -iE3=-E _ \= Etr=

8. In view of the aforesaid facts and circumstances of the case, this Court is inclined. to grant bail to the petitioner/A3 with th6 following conditions.
(i) The petitioner/A3 herein shall be released on his executing a personal bond for Rs.1,00,000/-(Rupees one lakh only) with two sureties for a like sum each to the satisfaction of the learned I Additional District & Sessions Judge-Gum-Special Judge for Trial of Offences under NDPS Act, Visakhapatnam; (ii) On release, the petitioner shall appear before the Station House Officer concerned on -every Sunday in between 10.00 am and 1.00 pm for a period of three months; (iii) the petitioner shall not tamper with the evidence and hamper the investigation and shall cooperate for investigation. 9.
