Neutral Citation No. - 2025:AHC:87044 Court No. - 4 Case :- WRIT - A No. - 5087 of 2025 Petitioner :- Vishnu Vijay Singh Respondent :- Union Of India And 3 Others Counsel for Petitioner :- Anand Kumar Pandey Counsel for Respondent :- A.S.G.I.,Rajesh Tripathi Hon'ble Ajit Kumar,J.
1. Instructions placed today are taken on record.
2. Heard learned counsel for petitioner and Shri Rajesh Tripathi,
learned counsel for respondents.
3. In compliance of the last order of this Court, Shri Rajesh Tripathi, learned counsel for respondent has placed review medical opinion in which petitioner has been declared unfit for the substandard vision as was so held unfit in the first medical examination.
4. Shri Tripathi, learned counsel for respondent has further drawn the attention of the Court to the first medical report to demonstrate that as far as the second deficiency i.e. GENU RECURVATUM, VARUM absent at BHDC failed to appear.
5. Learned counsel for the petitioner tried to meet the argument by submitting that he was not aware about the second deficiency.
6. Having heard learned counsel for the parties and having considered the instructions placed before the Court, the Court is of the view that if the petitioner was declared medically unfit for two deficiencies in the first medical examination and he himself applied for review medical/ appeal, he could not have set up a claim that he was not aware of the second deficiency since the petitioner has been found to be not medically fit for substandard vision and the second deficiency remain same as was there in the first medical examination.
7. In view of the above, I decline to grant indulgence in the matter.
8. Petition fails and is accordingly dismissed.
