1. This is the first bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who is apprehending his arrest in connection with Crime No.36/2025 registered at Police Station – Duldula, District-Jashpur (C.G.) for the offence punishable under Sections 4, 6 and 10 of the Chhattisgarh Agricultural Cattle.

2 perusal of which while conducting raid, he seized 2 baffelos and 1 pickup vehicle numbered JH 01 CP 2811, where after the vehicle driver was arrested and present applicant is a registered owner of the said vehicle, therefore, FIR has been registered against the applicant. Hence, this bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the case. It is further argued by the learned counsel for the applicant that applicant is owner of said vehicle, in which buffaloes were transported and runs vehicle rental business for which he rented his vehicle for transportation of buffaloes and merely doing legal business. He also submits that applicant has no criminal antecedent, investigation and trial may take some time, therefore, it is prayed that the applicant may be enlarged on anticipatory bail.
4. On the other hand, learned State counsel appearing for the non- applicant/State opposes the anticipatory bail application and submits that applicant is a resident of the State of Jharkhand.
5. I have heard learned counsel appearing for the parties and perused the case diary.
6. Considering the facts and circumstances of the case, nature and gravity of offence, allegations levelled against the applicant,
submissions made by learned counsel for the parties and the fact that applicant has no criminal antecedent, this Court is of the view that the applicant is entitled to be released on anticipatory bail in this case.
7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant– Shamad Quraishi Hussain on
3 executing a personal bond with one local surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant shall not involve themself in any offence of similar nature in future.
