PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 657 of 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A1 and A2, seeking regular bail, in Crime No.89 of 2024 of Mothugudem Police Station, East Godavari District, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(C) of the NDPS, Act. 2. Brief facts of the case are that, on 13.12.2024 at 06.30 PM, at opposite of Mothugudem P.S., Chinturu Mandal, where the S.I., of Police, Mothugudem P.S., while conducting vehicle checking along with his staff in the presence of mediators in which they found A1 and A2 were trying to transport 56 kgs of Ganja in three plastic bags in Nissan Terrano Car from Kalimela, Odisha state to Maharastra State illegeally, the SI of Police, Mothugudem apprehended A1 and A2 and seized 56 kgs of Ganja, Nissan Terrano Car bearing No. MH 02 DG 9817, 2 touch pad mobiles from their possession. Consequently a case was registered against the accused. 3. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. The petitioners herein were arrested on 13.12.2024 and since then they have been in judicial custody. The quantity of contraband involved in present crime is 56 Kgs of Ganja, which is a commercial quantity. Statutory period is 3 also not over. Learned Assistant Public Prosecutor vehemently opposed the petition in the light of Section 37 of NDPS Act. In view of the aforesaid facts and circumstances of the case, this Court does not find any grounds to consider the case of the Petitioners. 5. Accordingly, the Criminal Petition is dismissed.
