1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.77/2021 registered at Police Station – Civil Line District-Raipur (C.G.) for the offences punishable under Sections 420, 407, 471, 468 and read with Section 34 of IPC.
2. Prosecution story in brief is that the complainant namely Vinay Agrawal made a complaint case before the court of Chief VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.09.26 17:50:27 +0530
2 Judicial Magistrate Raipur on dated 27/04/2016. It is alleged that as per complaint case moved by Vinay Agrawal in Village Bhoring Patwari Halka No. 84, RNM. Tahsil and District Raipur bearing khasra No. 2285, 4781,, 4782 Rakba 0.06, 0.040 hectare total khasra No. 03 total Rakba 0.610 for sale of land and agreement has been executed a sum of Rs. 5,00,000/- was done and Rs. 4,90,000/- in the name of Ripan Sahu, Lallu Dhritlahre have been obtained with conspiracy. In respect of that after investigation and order has been passed to submit a final report thereafter the concerned police station Civil Line Raipur registered in Zero for an offence and case has been transferred in police station Tumgaon, District Mahasamund, numbari offence for registering the case on the basis of that in crime No. 30/2022 for an offence under section 420, 34 of IPC
1860. During the course of investigation they have created fake and fraudulently for getting the amount to execute the Agreement at Raipur the matter has returned back in police station Civil Line Raipur, thereafter the crime No.77/2021 for an offence punishable under section 420, 467,468,471 read with section 34 of IPC and in this case the applicant/accused has absconded saying it on dated 09/02/2023 the charge sheet has been filed before the court of learned Chief Judicial Magistrate, Raipur.

Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. It has been argued by learned counsel for the applicant that the
3 offence which has been complaint is of the year 2015 and on the basis of said complaint present FIR has been lodged against the present applicant. He further submits that the applicant was not aware about the present case, when the police visited his house he came to know about the instant case. He also submits that co-accused has already been granted bail in same crime number i.e. 77 of 2021 by the coordinate Bench of this Court in MCRC No.27 of 2023 vide order dated 13.04.2023. Further, investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.

Learned counsel for the State has pointed out that the bail rejection order passed by the learned trial court on 10.09.2025, wherein case crime number mentioned as 77 of 2025 in place of 77 of 2021, and it has correctly been mentioned in the last portion in the said order i.e.77 of 2021 and submits that the applicant has been absconding since the date of registration of the offence, and investigation against him is ongoing, therefore, the applicant is not entitled for grant of anticipatory bail in the present case.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties and further the fact that the trial of the instant case is going on and the co-accused person has already been granted bail by the
4 Coordinate bench of this Court in same crime No.77/2021 in MCRC No.27 of 2023 vide order dated 13.04.2023 and the applicant is stated to be absconding during the trial, thus, I am not inclined to grant anticipatory bail to the applicant.

Accordingly, the anticipatory bail application of the applicant– Ripan Sahu filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.77/2021 registered at Police Station – Civil Line District-Raipur (C.G.) for the offences punishable under Sections 420, 407, 471, 468 and read with Section 34 of IPC. is rejected.
