ORDER:
1. Heard the submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioner submits that the petitioner was arraigned as A. 10 in S.C. No.640 of 2023 on the file of the Special Court for Speedy Trial of Offences under POCSCO Act, Guntur, for the alleged offences under Sections 354(c), 509, 506 read with 34 of the Indian Penal Code, 1860 end Sections 12 and 14 of the Protection of Children from Sexual Offences Act, 2012 and Sections 66-E, 67-A, 67B of the Information Technology Act.
3. The learned counsel for the petitioner submits that there are no specific overt acts against the petitioner and that the only allegation against the petitioner is that the police have recovered his mobile phone and have retrieved the data from the phone memory and SIM cards.
4. The learned Assistant Public Prosecutor appearing for the State submits that the allegations against the petitioner are severe in nature. It is submitted that the police have concluded their investigation, received the forensic analysis report, and filed a detailed charge sheet. It is also submitted that the involvement of the petitioner is also evident from the charge sheet and the forensic analysis report.

Considering the nature of the allegations and the fact that the police have recorded the statement of as many as 29 witnesses, including the list of witnesses who speak about the analysis of the data seized from the mobile phone of the accused, this court is not inclined to adjudicate the issue at this stage. However, it is left open for the petitioner to take all the grounds before the trial court when the matter is taken up for trial.
6. With the above, the criminal petition is dismissed.
7. Pending applications, if any, shall stand closed.
