Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The present writ petition has been filed by the petitioner assailing the order dated 08.06.2016 passed by the 3rd respondent with further direction to consider the case of the petitioner for inter-district transfer from Phoolwati Devi Kanya Inter College, Moradabad to Agrasen Inter College, Sikandrabad, Bulandshahar. 3. In fact, the petitioner made an application for transfer from Phoolwati Devi Kanya Inter College, Moradabad to Agrasen Inter College, Sikandrabad, Bulandshahar. As per averments made, the respondent- institution as well as intending college i.e. Agrasen Inter College, Sikandrabad, Bulandshahar has no objection. Though it has also been clarified that there is clear existing vacancy but the respondents rejected the case of the petitioner vide impugned order only on the ground that there is no existing policy of inter-district transfer. 4. The respondents, after filing counter affidavit, have taken the same stand in the counter affidavit. The petitioner has filed rejoinder affidavit bring it to the notice of this Court the Government Order dated 07.07.2023 whereby the respondents have considered and amended the provisions of the U.P. Intermediate Education Act, 1921. Relevant portion of the Government Order dated 07.07.2023 is extracted herein below: 56-जहां आवेदन प्ऴ संस्था के 56-जहाँ आवेदन प्ऴ संस्था के ्ऺधान को ्ऺस्तुत िकया गया Versus Counsel for Petitioner(s) : Shravan Kumar Pandey, Shyam Narain Pandey Counsel for Respondent(s) : C.S.C. Satendra Singh Yadav .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) ्ऺधान को ्ऺस्तुत िकया गया है, वहां उसे अपनी संस्तुित के साथ संस्था के ्ऺबन्धक को अ्षसािरत करेगा। है, यहाँ वह उसे परी्षणोपरान्त अपनी संस्तुित के साथ िनधार्िरत अविध के अन्तगर्त आनलाइन अ्षसािरत करेगा तथा आनलाइन आवेदन प्ऴ की हाडर्कापी संस्था ्ऺबन्धक को ्ऺस्तुत करेगा। 5. Consequent to the said amendment, the State Government also issued the Government Order on 18.07.2023, relevant portion is reproduced herein below: 56-जहां आवेदन प्ऴ संस्था के ्ऺधान को ्ऺस्तुत िकया गया है, वहां उसे अपनी संस्तुित के साथ संस्था के ्ऺबन्धक को अ्षसािरत करेगा। 56-जहाँ आवेदन प्ऴ संस्था के ्ऺधान को ्ऺस्तुत िकया गया है, वहाँ वह उसे परी्षणोपरान्त अपनी संस्तुित के साथ िनधार्िरत अविध के अन्तगर्त आनलाइन अ्षसािरत करेगा तथा आनलाइन आवेदन प्ऴ की हाडर्कापी संस्था ्ऺबन्धक को ्ऺस्तुत करेगा। 6. In view of the said amendment, the respondents are entitled to consider the case of the petitioner for inter-district transfer. Hence, considering the submissions made by learned counsel for the parties, the impugned order dated 08.06.2016 passed by the 3rd respondent is set aside, permitting the petitioner to make afresh representation / request along with relevant material to the 3rd respondent within a period of one month from today. On filing of such representation/request, the 3rd respondent shall consider the same, if necessary, by getting instructions from both the institutions and pass appropriate orders within a period of two months thereafter. 7.
