The Court made the following order: The petitioner claims that he is the absolute owner and possessor of land admeasuring an extent of Ac. 1.32 cents in Sy.No.107 of Bhakarapeta Village, Chinnagottigallu Mandal, Tirupati District. It is his further case that, initially the land admeasuring an extent of Ac.2.64 cents was assigned in favor of his grandfather Sri Dasari Chinnappa vide A.M.No.872/4/1336, dated 27.02.1926. After demise of his grandfather, the entire extent was inherited by the sons of original assignee, Sri D. Venkata Naru, Sri D. Ranagaiah and Sri D.Siddaiah. would further submit that one of the sons of the original assignee namely Sri D.Rangaiah died issueless and the other two have equally shared the above-mentioned land. The petitioner submits that, the property claimed by him fell to his father’s share and after demise of his father, he came into possession of the said property pursuant to an oral partition entered among his brothers and since then, he is in possession and enjoyment of the same. 2. It is the further case of the petitioner that, the 5*^ respondent raised a dispute over the subject land against him I
3 and the same was eventually culminated in proceedings dated 08.12.2023, before the Joint Collector, Tirupati, whereunder the claim of the 5^^ respondent was rejected, and the said
order attained finality. It is further case of the petitioner that, at the instance of the 5^*^ respondent, the 4*^ respondent is again interfering with the petitioner’s possession. Questioning the said action, the present writ petition is filed.
3. When the matter is taken up for hearing, learned Assistant Government Pleader for Revenue placed on record the written instructions dated 25.04.2025, furnished by the 4''' respondent. On perusal of the same, the 4^^ respondent categorically asserted that, neither the 4*'' respondent nor the revenue field staff interfered with the petitioner’s possession the subject lands at any point of time and they have neither initiated any action nor issued any notice to the petitioner. The instructions dated 25.04.2024, are placed on record. over In view of the above submissions, this Court deems it appropriate to dispose of the writ petition by directing the respondents not to interfere with the petitioner’s possession the land admeasuring an extent of Ac. 1.32 cents in Sy.No.107 of
