2 ORDER:
The present Writ Petition, under Article 226 of Constitution of India, is filed by the petitioners seeking the following relief:
“…..to issue a Writ, Order or direction more particularly, one in the nature of a Writ of Mandamus, or any other appropriate Writ, order or direction directing the 1st Respondent to follow the procedure under Section 3-C(2) of the National Highways Act, 1956 and consider the objections of the Petitioners by giving an opportunity of being heard which were submitted pursuant to the Notification dated 17.7.2013 as published on 31.10.2013 in the interest of justice and pass such other or further orders as this Honourable Court may deem fit and proper …”
2. When the matter is called, there is no representation on behalf of the petitioners. However, Sri Mocherla Deepak Bhargav Ram, learned counsel, appearing on behalf of the respondents – NHAI, submits that the petitioners, without questioning the termination order, dated 13.11.2013, issued by the respondents vide proceedings No.NHAI/BOT-1/11019/102/2007/143, have filed the present Writ Petition and therefore the cause in the Writ Petition does not survive for adjudication.
3. Recording the aforesaid submission, the Writ Petition is dismissed as infructuous. No order as to costs.
