The present contempt application has been filed pleading willful disobedience of the order dated 14.11.2024 passed by this Court in Writ-A No. 18692 of 2022. In pursuance to the previous order passed by this Court, the Standing Counsel has filed a compliance affidavit of the opposite party disclosing that the orders have been passed permitting the applicant to join and the arrears of salary from 16.12.2024 to 12.5.2025 has been sent to the concerned Treasury for payment to the applicant. As the order passed by the writ Court, so far as compliance could be demanded in proceedings under the Contempt of Courts Act, 1971, has been complied by the opposite party, no further orders are required to be passed. It is clarified that that in case the amount sent to the Treasury for payment to the applicant, i.e., Rs. 170008/- is not credited in the account of the applicant by 31.5.2025, the applicant may file a recall application for recall of the present order or may file a fresh contempt application under the Contempt of Courts Act, 1971. So far as back wages previous to 16.12.2024 is concerned the applicant has the remedy to institute a fresh petition before the concerned Court in light of the judgement of the Division Bench of this Court in Sri Anil Kumar Gupta and Another Vs. Pawan Kumar Singh and 25 Others, (2016) 114 ALR 295 and Dharam Pal Singh Vs. State of U.P. and Others, (2015) 110 ALR 830. The contempt application is disposed of. Notices are discharged.
