The petitioner has been made accused in connection with POCSO Case No. 51 of 2023 arising out of Simariya P.S. Case No. 110 of 2023, for the offences registered under Sections 376, 379, 506 of the I.P.C., 1860 and Section 4 of the Protection of Children from Sexual Offence Act, pending in the Court of learned Special Judge, POCSO Act, Chatra. 3. The petitioner is alleged to have raped the niece of the informant 7-8 months prior to the lodging of the F.I.R. He had threatened her of dire consequences and continued to sexually exploit her. 4. Statement of the victim has been recorded during the trial. In her examination-in-chief, she has stated that the petitioner had raped her. 5. Learned counsel appearing on behalf of the petitioner has drawn the attention of this court towards the statement of the prosecutrix at Paragraph- 9 of the deposition in which she has stated that the accused has only caught hold of her. 6. It will not be proper to analyze the evidence of the victim at this stage because it will affect the final outcome of the Sessions Trial. 7. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Nandini/- Uploaded
