ORDER: This petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“to issue a writ order or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondent Nos.5 and 6 in non-disposing of the Appeal No.04/2019 filed under Section 73 of the Registration Act, 1908 as illegal, arbitrary and violation of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents to dispose of the Appeal No.04/2019 filed under Section 73 of the Registration Act, 1908 by consideration representation dated 18.03.2025 of the petitioner and pass” Though the petitioner made several allegations, during the course of hearing, learned counsel for the petitioner Sri B. Rama Shankar Rao requested this Court to issue a direction to the respondent authorities to dispose of the Appeal No.04/2019 preferred by the petitioner before the respondent authorities without touching the merits. 2. In view of limited request made by the learned counsel for the petitioner, the respondent authorities are directed to dispose of the Appeal No.04/2019 preferred by the petitioner, in accordance with law, though this Court is conscious about the principle laid down by the
3. 3 Honourable Apex Court in The Government of India v. P.Venkatesh” \ wherein the Honourable Apex Court held that such orders may make for a quick or easy disposal of cases in overburdened adjudicatory institutions. But, they do not serve to the cause of justice. As the learned counsel for the petitioner himself requested to issue a direction to the respondent authorities to dispose of the Appeal No.04/2019 preferred by the petitioner, this Court find no other alternative except to issue such direction. 4. In the result. Writ Petition is disposed of, directing the respondent authorities to dispose of the Appeal No.04/2019 preferred by the petitioner by considering the representation dated 18.03.2025 of the petitioner, in accordance with law, within three (03) months from the date of receipt of a copy of this order. There shall be no order as to costs.
