I.A.No.3 of 2025 (On being mentioned)
Learned counsel for the petitioner submits that the petitioner had been acquitted from the criminal case by judgment dated 30.09.2019 and later retired from service on
31.03.2022. However, in the operative portion of the judgment/order, respondents were
directed to release all retirement benefits as entitled along with interest from the date of acquittal, rather it ought to have been from the date of retirement as the retirement happened after the acquittal.
Learned counsel for the respondents also concurred with the said submissions.
In view of the above, this application is ordered and the operative portion of the order stands modified as follows:
“7. Accordingly, the Writ Petition is allowed and the respondents are directed to release all retirement benefits to the petitioner as entitled within two (02) months from the
2
date of receipt of a copy of this order. The respondents are further directed to pay aforesaid amount with interest @ 10% per annum from the date of retirement i.e. on 31.03.2022 till the date of payment.” ______ CGR,J
NOTE:
Registry is directed to issue the revised
order by replacing the above paragraph in the original order. B/o. ANS
