PUBLIC PROSECUTOR The Court made the following: ORDER:- The Criminal Petition, u/Sec.482 of B.N.S.S is filed on behalf of the petitioners/A1 to A3 and A5 to grant anticipatory bail in connection with Crime No.57/2025 of Punganur UPS, Chittoor District. 2) A case has been registered against the petitioners herein and others for the offence punishable u/Sec.332(b), 118(1), r/w3(5) B.N.S. 2 3) The case of the prosecution, in brief, is that: The defacto complainant is the husband of A1 and father of A2 and A3. The defacto complainant uses to work in chicken shop. The defacto complainant and petitioner no.1 herein have been suffering from years due to family issues. Wherein petitioner no.1 herein is the wife of the defacto complainant and other petitioners herein criminally trespassed into the house of Munni by broke opening the doors of the house and they started beating with iron rods and pipes and assaulted him and caused severe bleeding injuries on his head and body. On hearing the altercation, neighbours rushed to the spot and rescued the defacto complainant. On the complaint of the defacto complainant, the crime came to be registered against the petitioners. Anticipating arrest by police, the petitioners filed the present petition for anticipatory bail. Learned counsel for the petitioner contended that 1®* petitioner is wife of the defacto complainant, A2 is their son aged about 18 years and A3 and A4 are brothers. In the F.I.R it is stated that there were differences between A1 and her husband since five years. Due to the same false complaint was given by the defacto complainant to the police and prays to grant anticipatory bail to the petitioners. 4) On the other hand, learned Assistant Public Prosecutor confirms -filing of charge sheet by the police and opposed for grant of bail to the petitioners. Considering the submissions, this Court has carefully gone through the material placed on record. The allegation against the petitioners that on 18.02.2025 at about 10.30 pm, A1 and his family members went to the house of one Munni where the defacto complainant was said to be present at that time and all the accused persons beat him with rods and tiles on head and caused injuries. Considering the severity of the nature of the accusation made, this Court directed the Assistant Public Prosecutor to place the wound certificate which discloses that the defacto complainant sustained simple injuries and discharged from the hospital. Considering the nature of injuries as mentioned in the wound certificate, this Court finds that the allegations made against the petitioners do not fit in with the gravity of the accusation. The possibility of roping in the crime cannot be ruled out, in view of the existing family disputes between parties. Considering the close relationship between the petitioners and the defacto complainant, the possibility of their uniting together cannot be ruled out as the wound certificate reflects that the injuries sustained by the defacto complainant 5) non 6) 7) \ 4 are simple in nature, this Court finds that it is a fit case to grant anticipatory bail to the petitioners. Accordingly, the petitioners/A1 to A3 and A5 are directed to surrender before the Station House Officer concerned within two (2) such surrender, the petitioners shall be 8) weeks from today and released on bail on their executing a personal bond for a sum of on Rs.10,000/- (Rupees ten thousand only) each with two sureties for a like sum each to the satisfaction of the arresting police officials and the petitioners 2 to 4/A2, A3 and A5 shall appear before the Investigating Officer once in a fortnight i.e. on every 2^^ and 4*'^ Sunday between 10.00 a.m. and 1.00 p.m for a period of three (03) months. The Petitioners shall not cause any threat, inducement or promise to the prosecution witnesses. 9) With the above directions, the Criminal Petition is allowed. Sd/- P.U.V.
