1. This bail application under Section 483 B.N.S.S. has been filed by the petitioner in connection with the FIR No. 113/2025 registered at Police Station Kaithwara, District Deeg wherein she has been charged for the offence punishable under Sections 115(2), 126(2), 103(1), 352 and 333 of BNS, 2023. 2. Counsel for the petitioner submits that the petitioner is the mother-in-law of the deceased and the allegation against the petitioner and co-accused is that all of them have beaten the deceased due to which the deceased has died. Counsel submits that no specific overt act has been assigned to the petitioner. Counsel further submits that the petitioner is a lady and she has been in custody since the date of her arrest. Counsel submits that
[2025:RJ-JP:42427] (2 of 3) [CRLMB-12941/2025] trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioner. 3. Per contra, learned Public Prosecutor as well as counsel for the complainant oppose the bail application and submit that the daughter of the petitioner who is the wife of the deceased has named the petitioner as an accused along with other co-accused persons and all of sudden they have beaten the deceased and inflicted injury due to which deceased has died, hence the petitioner does not deserve any indulgence of bail by this Court and the same has been rejected. 4 Heard and considered the submissions made at Bar and perused the material available on record. 5.
Considering the arguments put forward by the learned counsel for the petitioner and looking to the fact that no specific overt act has been levelled against the petitioner and also considering the fact that the petitioner is a lady and she has been in custody since the date of her arrest and since the trial will take its own time to conclude, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner under Section 483 BNSS. 6. Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner-Kamla W/o Omprakash @ Amilal arrested in connection with aforementioned FIR, may be released on bail; provided she furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with
