Apart from this, the issue that has been highlighted is that even when the Andhra Pradesh Prohibition of Smoking and Health Protection Act, 2002, prohibits sale of cigarettes from any establishment which is within one hundred meters of an educational institution, the authorities have failed to check and implement the provisions of the aforementioned Act. Details have not been given in the petition as to which are those establishments, which are found to be selling cigarettes within the prohibited distance of an educational institution, yet we permit the petitioner to file a 2 HCJ & RC, J W.P(PIL) No: 141 of 2024 representation with the Municipal Corporation, Guntur, as also the District Medical and Health Officer, Guntur, giving details of any such establishment which is found to be doing business in violation of the provisions of the Act supra. The authorities shall take notice of the said representation, verify the correctness of the same and take appropriate action in accordance with law. Apart from the information furnished by the petitioner, the concerned authorities shall also conduct randomly an exercise to find out as to whether there are any such establishments who are indulging in the sale of cigarettes within the prohibited limits and take action against the concerned in accordance with law. The Writ Petition (PIL) is, accordingly, disposed of. No costs. Pending miscellaneous applications, if any, shall stand closed.
