Mr. Mahavir Kohli, Advocate for the petitioner. Mr. Saurabh Adhikari, Advocate for the respondents. The petitioner was posted in SSB Srinagar, Garhwal on his request. The request was based on the family condition including the health of his mother. Now, the petitioner has been transferred to Tejpur, Assam again from which he was transferred to Srinagar, Garhwal. This transfer is impugned. On 01.04.2025, when the matter was taken up, it was argued on behalf of the petitioner that he may be posted at some nearby places like Champawat, Delhi, Lucknow etc., so that he could also fulfill his family responsibilities. On that date, the Court wanted to know from the learned counsel for the respondents, as to why the petitioner is not posted to nearby places keeping in view the fact that earlier he was posted at Srinagar, Garhwal at his own request based on his family condition. Today, learned counsel for the respondents gave a statement that the respondents are considering the request of the petitioner so as to post him at his place of choice. But, if it is not possible, the respondents shall make all endeavor that he be posted at the nearby places where there are medical facilities available. The Court takes on record the statement given by learned counsel for the respondents. In view of the statement given by learned counsel for the respondents, nothing survives in this petition.
