The petitioners were appointed as Auxiliary Nurse and Midwife (ANM) / Multi Purpose Health Assistant (MPHA) on contract basis between 2007-2009. They have rendered 15 years of service and they have been working in the same position and the consolidated pay now being paid to them is Rs. 19,000/- per month. The Government of Andhra Pradesh, the representations received from the contract employees working in the Government Departments^ appointed Committee to review the contractual pursuant to system of engaging employees and make recommendations. Accordingly, G.O.Rt.No.3080, General Administration (Cabinet) Department, It was resolved to issue minimum time scale to contractual employees working in various departments. Subsequently, the Government of Andhra Pradesh issued G.O.Ms.No.12, Finance (HR.I-PIg Policy) Department dated 28.01.2019. Subsequently, the Government issued from time to time Government Orders on the issue. dated 09.09.2014 was issued. & has In 2021, a comprehensive G.O., was issued granting minimum time scale to the employees working in Government Departments, Universities, Societies, KGBV and Model Schools in the revised Pay Scales, 2015, of the relevant posts. Vide G.O.Ms.No.5 dated 17.01.2022, the Commissioner of Health Family Welfare issued proceedings dated 29.04.2022, to extend minimum time scale to contract employees working under the control of District Medical and and Health officials. 3 4. The respondents filed counter affidavit contending that the petitioners are employed under National Health Mission. They were not appointed against vacant post. Their wages are on consolidated basis. The respective G.Os relied upon by the petitioners and governing the minimum time scale are not applicable to the petitioners, since the petitioners are working under National Health Scheme. 5. The learned counsel for the petitioners relies on the decision of the Hon’ble Apex Court in the case of State of Punjab and Others \/s. Jagjit Singh and Others^ and the decision of the Division Bench of this Court in the case of RTeJeswari and others Vs. State of A.P. and Others^. The Hon’ble Apex court in the case of Jagjit Singh, observed as follows: “56. We shall now deal with the claim of temporary employees before this Court. 57. There is no room for any doubt that the principle of "equal pay for equal work" has emerged from an interpretation of different provisions of the Constitution. The principle has been expounded through a large number of judgments rendered by this Court, and constitutes law declared by this Court. The same is binding on all the courts in India under Article 141 of the Constitution of India. The parameters of the principle have been summarised by us in para 42 hereinabove. The principle of "equal pay for equal work" has also been extended to temporary employees (differently work-charge, daily wage, casual, ad hoc, contractual, and the like). The described as legal position, relating to temporary employees has been summarised by us, in para 44 hereinabove. The above legal position which has been repeatedly declared, is being reiterated by us yet again. M20J7)1SCC 148 ^ 2024 see Online AP 762 58. In our considered view, it is fallacious to determine artificial parameters to deny fruits of labour An employee engaged for the same work cannot be paid less than another who performs the same duties and responsibiliiies. Certainly not, in a welfare State. Such an action besides being demeaning, strikes at the very foundation of human dignity. Anyone, who is compelled to work at a lesser wage does not do so voluntarily. He does so to provide food and shelter to his family, at the cost of his self-respect and dignity, at the cost of his self-worth, and at the cost of his integrity. For he knows that his dependants would suffer immensely, if he does not accept the lesser wage. Any act of paying less wages as compared to others similarly situate constitutes an act of exploitative enslavement, emerging out of a domineering position. Undoubtedly, the action is oppressive, suppressive and coercive, as it compels involuntary subjugation." The argument of the Government Pleader that the petitioners not entitled to the minimum time scale, as they are not appointed against a sanctioned post and that they are appointed under a scheme of the Government of India, is not tenable for the reason that the petitioners appointed under a notification issued by the erstwhile State of Andhra Pradesh on 06.02.2007, inviting for applications from eligible candidates to work ANMs on contract basis. They were selected by the respective District Selection Committees, the appointment order was for a period of one year, and their contract was made extendable for a further period subject to satisfactory service. It further specifies that they are also entitled to incentives at the rates fixed by the Commissioner, depending performance. Thereafter, their services were continued. In light of the denying them equal pay for equal work on the ground that they were not appointed against a sanctioned post would only amount to discrimination. The 6. are were as on their same. G.O.Ms.No.40 dated 18.06.2021 issued on the subject is made applicable to the contractual employees working in Government Departments. The distinction sought to be made by the learned Government Pleader that they are working under a National Health Scheme is not tenable for the reason that in the absence of any such specific exclusion shown under the relevant G.O(s) and having regard to the length of their service which is more than 15 years. Therefore, placing reliance on the decision of the Hon ble Apex of Jagjit Singh and the Division Bench of this Court in 7.
