This Court doth Order and decree as follows:
1. That the appeal be and is hereby disposed of;
2. That the respondents/claimants be and compensation of Rs.43,20,000/-;
3.
That the respondents/claimants be and are hereby entitled to receive the total compensation amount as per the apportionment made by the Tribunal below in the same ratio;
4. That the difference of Court Fee be paid by the claimants before the Tribunal below to the account of the said M.V.O.P. within a period of four (04) weeks from the date of receipt of copy of this judgment;
5. That on payment of the court fee amount, the claimants be and hereby entitled to withdraw the compensation amount as directed;

learned counsel for the appellant and the
learned counsel for the respondents/claimants. This appeal was preferred against the order in IVI.V.O.P.No.327 of 2009 on the file of the Chairman, Motor Accident Claims Tribunal-cum-Principal District Judge, Kadapa, dated
31.01.2014.
2. The Tribunal awarded compensation amount of Rs.41,15,000/- with proportionate costs directing the respondent Nos.1,2 and 5 therein to pay the same jointly and severally. The Tribunal taken the income of the deceased as Rs.30,000/- per month following the judgment of Sara/a Verma and others v. Delhi Transport Corporation and another^. The Tribunal arrived at the said amount relying upon the documents marked under Ex.A7 to Ex.A48. The Tribunal awarded Rs. 10,000/- towards loss of consortium, Rs.5,000/- towards funeral expenses and Rs.50,000/- towards loss of love and affection. In total, it arrived at Rs.41,15,000/- towards compensation payable to the claimants therein.

But insofar as the loss of consortium is concerned, this Court feels that the Tribunal did not arrive at just conclusion by calculating the same. Accordingly, for the six (6) claimants Rs.40,000/- each, i.e., the parents, wife and children of the deceased, is taken into consideration and accordingly in addition to Rs.10,000/- granted, Rs.2,30,000/- towards loss of consortium for all the claimants is added. Since we have considered the payment of compensation towards loss of consortium, the awarded amount of Rs.50,000/- towards loss of love and affection is deleted. For the funeral expenses, we have added Rs.10,000/- the Tribunal awarded only Rs.5,000/- for the same. Since there loss of estate awarded, we have awarded the same at the rate of In total, we have added Rs.2,05,000/- towards just compensation for the award of the compensation granted by the Tribunal below i.e., Rs.41,15,000/-. Though there is no cross appeal, in view of the settled legal position to arrive at a just compensation this more as was no Rs.15,000/-. exercise is made in this appeal. Accordingly, the respondents/claimants are awarded compensation of Rs.43,20,000/- and the other conditions fixed by the Tribunal are not interfered with. The respondents/claimants are entitled to receive the total compensation amount as per the apportionment made by the Tribunal below in the same ratio. The difference of Court Fee shall
