2. GP FOR LAND ACQUISITION The Court made the following order: Heard Sri K. Ramesh Babu, learned counsel for the petitioners; Sri Praveen Kumar, learned Assistant Government Pleader for Roads and Buildings, for respondents 1 and 7 to 9 and Sri Bhagat Singh, learned Assistant Government Pleader for Revenue, for respondents 2 to 6.
2. Learned counsel for the petitioners would submit that respondents 7 to 9 and their staff, under the guise of widening and laying the road are interfering with the petitioners’ possession and enjoyment of properties of an extent of 593 square yards, 254 square yards, 475 square yards 94 ½ square yards, 87 square yards, 133.8 square yards and 23.5 square yards
respectively situated in survey No.256/A-1A2, situated at Gramakantam Ward No.1, 2, 3, Amaravathi Village and Mandal, Palanadu District. He would submit that no notice was issued to the petitioners.
3. Learned Assistant Government Pleader for Roads and Buildings and learned Assistant Government Pleader for Revenue, on instructions would submit that respondents 7 to 9, as well as the revenue authorities, are not interfering with the petitioners’ enjoyment of the aforementioned properties.
4. Given the above submissions regarding non-interference of the authorities with the petitioners’ enjoyment of the above properties, keeping this writ petition pending will not serve any purpose.
5. Hence, this writ petition is disposed of at the admission stage with the consent of learned counsel on either side, directing the respondents to follow due process of law, in case the respondents need the aforementioned property for any public purpose. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
