1.PUBLIC PROSECUTOR The Court made the following: This Criminal Petition under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A2 and A6, seeking regular bail in crime No.66 of 2024 of Moothugudem Police Station, registered for the offence punishable under Section 111 (2)(b) of the BNS and Sections 8(c) r/w 20(b)(ii)(c) of the NDPS Act. 2. Case of the prosecution, in brief, iS that On 08.09.2024, the Sub_ Inspector of police along with his staff and mediators rushed to opposite Mothugudem Police Station, and Caught the accused in possession Of 110Kgs of Ganja. The contraband along With Other material Was Seized under the cover of mediators report. 3. Heard. Perused the material On record. 4.
Learned counsel for the Petitioners contended that the petitioners were arrested on o8.09.2024 and since then they have been in J-udiCial \----_ r--so I-- _,-_-~
•ca custody and that statutoriy period of 180 days is completed and police have not filed charge sheet and requests to enlarge the petitioners on bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filI'ng Of Charge Sheet by the Poll-Ce even after statutory PerI'Od I-S completed, but opposed to grant bail. 6. As seen from the record, the petI'tiOnerS Were remanded tojudicjaI custody on O8.09.2024 and charge sheet has not been filed. Most of the wl'tnesses are shown to be officI'al Witnesses and the release of the accused would not cause hampering of investigation. The petitioners had permanent abode and there is no possibility of their fleeI-ng away from J-uStiCe. 7. ln view of the aforesaid facts and cI'rCumStanCeS Of the Case, this Court I-S inclined to grant baI'I to the petitI'OnerS herel®n WI-th the following conditions: i. The petitioners herein/A2 and A6 shall be released on bail on their executing a personal bond for Rs.50,000/- (Rupees fI'fty thousand only) each with two (o2) sureties for a lI-ke Sum each tO the Satisfaction of the learned Judicial Magistrate of FI-rSt class, Rampachodavaram. ij.
