ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs;-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in including the petitioner’s land covered in R.S.No.31/2, 32/1, 33/1 to an extent of 398. 1/3 square yards (plot No. 34, D. No. 26-9-1) situated at Eluru Municipality, Eluru District in prohibitory list under Section 22-A of the Registration Act as illegal, arbitrary and contrary to the provisions of Registration Act and consequently direct the respondents to delete the petitioner’s subject land from the prohibitory list and pass such other order. ”

learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for the respondents. The
learned counsel for the petitioner submits that the
3. petitioner is the owner and possessor of the house plot bearing No.34 in an extent of 398 square yards in an approved layout of Eluru Non Gazetted Officers Co-operative House Building society situated in R.S.No.31/2, 32/1 and 33/1 out of a total extent of Ac.3.48 cents, having acquired the same through registered sale deed dated on
23.04.1982. After such acquisition of the subject land, the petitioner got constructed a house and has been in possession and enjoyment of the subject house property since 1982. While things stood thus, in the meanwhile, the respondents included the subject
3 property in the list of prohibitory properties under Section 22-A of Registration Act, 1908, for which the petitioner submitted a representation dated 01.07.2024 claiming as subject land is patta land and also duly approved layout and for deletion of the same from the prohibitory list under Section 22-A of Registration Act. Even after receipt of the same, the respondents neither passed any order nor issued any other proceedings. On the other hand, the learned Assistant Government Pleader for Revenue submits that since the petitioner is claiming his rights through a registered sale deed, the claim of the petitioner can be considered if he made proper application through Mee-Seva for deletion of subject property from the prohibitory list under Section 22-
4. A Registration Act. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents and on perusal of the material placed on record, this Court is constrained to dispose of the present writ petition directing the petitioner to submit proper application through Mee- Seva seeking deletion of house property from the prohibitory list under Section 22-A of Registration Act, within a period of three (03) weeks from the date of receipt of a copy of this order. After receipt of such application, the second respondent herein is directed to pass appropriate orders, after providing opportunity of hearing to the

4 petitioner or other stakeholders, if any, within a period of four (04) months thereafter. Accordingly, the writ petition is disposed of. There shall be no

order as to costs. As a sequel miscellaneous applications, pending, if any, shall also stand closed.
