1. The petitioner who is working as Assistant Society Manager and posted at Paddy Procurement Centre, Tamnar, District- Raigarh has filed this petitioner assailing order dated 23.01.2025 by which his services have been terminated.

Learned counsel for the petitioner would submit that the impugned termination order dated 23.01.2025 is bad and illegal as no opportunity of hearing was granted to the petitioner and would pray for setting aside the impugned order. On the other hand, learned State counsel would submit that the instant petition is not maintainable as the petitioner has alternate remedy under the Chhattisgarh Cooperative Societies Act, 1960 (for short “the Act, 1960”) which provides complete mechanism for resolving the grievances of the employees working with Cooperative Societies and would pray for dismissal of the writ petition.

In view of the above, the instant petition is disposed of granting liberty to the petitioner to file an application under Section 55(2) of the Act, 1960, raising service dispute under the Act, 1960 within a period of 30 days from the date of receipt of copy of this order. In the eventuality of filing an application by the petitioner under Section 55(2) of the Act, 1960, the same shall be considered and decided by the concerned authorities on its own merits. It is also directed that if the application is filed by petitioner within stipulated time period given by this Court, neither the respondents nor the authorities will take plea of limitation and the application of the petitioner will be decided on its own merits.
5. With the aforesaid observation and direction, the writ petition is
