Hon’ble Ravindra Maithani, J.(Oral) By means of instant petition, the petitioner has sought the following reliefs:- “(i) Issue a writ order or direction in the nature Certiorari and thereby quash the order dated 28.12.2021 (Annexure No.5), whereby the respondents have recovered an amount Rs. 2,88,559/- from the post retiral benefits including Gratuity amount of the petitioner after superannuation. (ii) Issue a writ order or direction in the nature of mandamus commanding the respondent Corporation to release the recovered amount by the respondent Corporation in favour of the petitioner amounting Rs. 2,88,559/- and refix the post retiral benefits on the basis of last drawn salary/last payment certificate. (iii) Issue any suitable order or direction as this Hon’ble Court may deem fit and proper in the circumstances of the case. 2 (iv) To award the cost of the writ petition to the petitioner.” 2. Heard learned counsel for the parties and perused the record. 3. At the very outset, learned counsel for the petitioner would submit that the matter is squarely covered by the judgment dated 04.04.2024, passed by the Division Bench of this Court in Special Appeal No. 245 of 2022, Managing Director, Uttarakhand Transport Corporation, Dehradun and others Vs. Ashok Kumar Saxena; and connected cases. 4. This fact is admitted by the learned counsel for the respondents. 5. Since the matter is covered, instant petition is decided in terms of the judgment dated 04.04.2024, passed by the Division Bench of this Court in Special Appeal No. 245 of 2022, Managing Director, Uttarakhand Transport Corporation, Dehradun and others Vs.
