The Case of the prosecution, in brief, is thaton 30.10.2024 on receiptof credible informatl-on about illegal transporfatI®On Of Ganja, the Inspector of PolI'Ce, G.Madugula police station along with his staff and mediators rLlshed to M.R.O Office J-unCtI-On and started conducting vehicle checking. At about 08.00 hrs three persons cc)mI®ng On foot Carrying three bags from Nurmathi side tow'ards G.Madugula. on seeing the police, they trI'ed {O abscond and then the police apprehended them and found that three white plastic gunny bags of ganja weighing 57 kgs. 3. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor. perused the record. 4. Sri Sravan Kumar Nadena, learned counsel representing Sri Puvvala srinivasa Rao, learned counsel for the petI'tjOner Submits that the Petitl'Oner has been in judicial custody for the past 180 days. 5. Ms.Akhila Nal-du, learned Assl'stant public Prosecutor also conceded with the sal'd submission of learned counsel for the petitl-oner. However, she submits that the investigatI'On iS not yet completed. 6. The alleged contraband is 57 kgs. In view of the fact that the petitioner completed 180 days of detentI'On in the J-udiCial Custody, the Petitioner/accused No.3 is entl'tled for default bail as per sect,-on 36A(4) of the fN.D.P.S. Since the investigation iS not yet completed and there are nO specific reasons for further detention of the petitioner beyond the period of 180 days, even as per the case of the prosecution, I am inclined to enlarge the petitioner on bail with the following Conditions: i) The petitioner shall be enlarged On bail Subject tot him executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), With' two Sureties each for the like sum each to the satisfaction of the learned Judicial Magistrate of First class, Paderu. ii) The petitioner shall not directly or indirectly influence Or threaten or meet the witnesses including .the de-facto complainant. iii) The petitioner shall cooperate With the investigating Officer in further investigation of the case and shall be available to the investigating officer as and when called by him. iv) The petitioner shall appear before the investigating Officer on every saturday in between 10:00 am and 05:00 pm till the cognizance is taken by the learned I Additional District and sessions Judge-Special Judge for Trial of-Offences under N.D.P.S. Act, Visakhapatnam.
