Raghunandan Rao) The respondents 1 to 3 herein, had approached this Court, by way of W.P.No.30865 of 2022, contended that, the respondent authorities were interfering with the rights and possession over the land to an extent of Ac.1.50 cents in Sy.No.1954, Ac.0.75 cents in Sy.No.1954/9 and Ac.0.50 cents in Sy.No.1954/8 at Kothapalli Village Fields, H/o. Doddipalli, Piler Mandal, Annamayya District. 2 RRR,J & Dr.KMR,] W.A.No.489of2025 The case of the respondents 1 to 3 was that, the said land assigned to them, by way of a D.K.T. Patta, dated 23.06.2003, and that, the respondent authorities are interfering with their land despite the fact that the D Form Patta was granted to them. 2. was 3. The respondent authorities, in the Writ Petition, contended that the land in Sy.No.1954, is classified as ‘Un-Assessed Waste Dry (Gayalu) Re-survey and Re-settlement Register of Doddipalle village and no D Form Pattas had been issued to the respondents 1 to 3. The appellant herein, had impleaded himself in the Writ Petition, on the ground that, he had purchased the land to an extent of Ac.1.50 cents in Sy.No.1954/9 and Ac.1.00 cents in Sy.No.1954/8 from the legal heirs of Sri G. Venkata Ramana Reddy, to whom the aforesaid land had been issued, under the Ex-Servicemen Quota 14.12.2007. as per , on 4. A learned Single Judge, disposed of the Writ Petition, by an order, dated 20.02.2025, holding that the question of whether the documents produced by the respondents 1 to 3 are fake or not, cannot be simply accepted on the basis of a statement. Consequently, the learned Single Judge, directed the Authorities not to interfere with the possession of the respondents 1 to 3 except in accordance with the procedure established under law and that, it would be open to the respondent - Tahsildar to go into the question of whether the Pattas relied upon by the respondents 1 to 3 genuine pattas or not and liberty was also granted to the appellant to approach a Civil Court to adjudicate his claim. are V 3 RRRJ & Dr.KMRJ W.A.No.489 of 2025 Aggrieved by the said judgment, the appellant has approached this Court, by way of the present Writ Appeal. 5. Sri V. Surendra Reddy, the learned counsel appearing for the appellant would submit that, the present Writ Appeal has been filed as the Tahsildar was refusing to go into the question of genuiness of Pattas and other records 6. relied upon by the respondents 1 to 3. To the mind of this Court, the order of the learned Single Judge is quite clear as liberty has been given to the respondent authorities to initiate appropriate action, if the authorities were of the opinion that the Pattas are 7. fake. In such circumstances, the apprehension of the appellant that, the 8. respondent authorities would not go into the question, is misplaced. Accordingly, this Writ Appeal is disposed of.
