ORDER: I/ THE HON'BLE SRI JUSTICE I.MALLIKARJUNA RAO CRIMINAL PETITION No.2772 of 2025 This Criminal Petition under Sections 480 and 483 of B.N.S.S., has been filed by the petitioner/A3, seeking regular bail in Cr.No.113/2O24 of K.D.Peta Police Station, Anakapalle District. 2. The above said crime was registere.d against the petitioner/A3 herein and others for the offence punishable u/See.20(b)(ii)(C), 25 r/w 8(c) of the NDPS Act. 3. Case of the prosecution, in brief, is that, on 04.10.2024 at about 8.00 am, on receipt of credible information with regard to illegal possession and transportation of ganja, the Sub-Inspector of Police, along with his staff was conducting vehicle checking at A.L.Puram Village, AIIuri Park, Golugonda Mandal. They found one auto bearing registration no.AP 31 TN 4654 coming towards them. On seeing police, the inmates in the auto who are six in number, stopped the auto and tried to escape. Then police apprehended five of them while the other one escaped. On enquiry, they disclosed their identity particulars as that of A2 to A5 and police found 181 kgs of ganja in their possession. They were arrested and remanded to Court for judicial custody and the contraband and auto were seized. 4.
Learned counsel for the petitioner contended that the petitioner is in judicial custody from 04.10.2024 and most of the investigation is completed ctsszfzs3' t.-
l|. -2 // and after expiry of statutory period, police have not filed charge sheet, as such the petitioner is entitled for statutory bail. 5. On the other hand, learned Assistant Public Prosecutor also confirms non-filing of charge sheet by the police even after statutory period is completed, but opposed to grant bail. He further submitted that nO antecedents are reported against the petitioner. 6. Heard both sides. 7. Given thatthe petitioner has been in remand Since 04.10.2024, this court views that most of the investigation concerning the role of the petitioner in the commission of the offence has likely been concluded. lt has been submitted that the petitioner is a permanent resident of vattibusula village, ASR District and there is nO Credible apprehension Of his fleeing away from justice. Additionally, since most of the Witnesses are official, the release of the petitioner would not 'lmpede the investigation or tamper with the evidence and also after completion of statutory period, police have not filed charge sheet and also they have not f'lled any petition for extension of time for investigation. In view of seizure of huge quantity of contraband, impos'lng stringent conditions would meet the ends of I justice. 8. In view of the aforesaid facts and Circumstances Of the Case, this court is inclined to grant bail to the petitioner/A3 with the following cond'ltions. ' ``- ``_dr r=2,
