ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused No.3 for granting of bail in connection with Crime No.261 of 2024 of Kanchikacherla Police Station, NTR District, registered for the alleged offences punishable under Section 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). The case of the prosecution is that on 03.09.2024 at about 12:00 hours, acting on credible information, the Circle Inspector of Police, Nandigama Rural, along with the Tahsildar, mediators, and staff, Akshaya Hotel, NH-65,
2. No.1 apprehended Accused Kanchikacherla Village, as he attempted to flee. Investigation revealed near that Accused Nos.1 and 2, natives of Baramati, Maharashtra, had procured 300 Kgs of Ganja from Accused No.3 at Lothugadda Junction, Visakhapatnam District, on 01.09.2024, and were transporting it in a Hyundai Creta (MH 04 M 5751) to Accused No.4 in Mumbai. Due to flooding, they halted near Akshaya Hotel. During the search, 300 Kgs of Ganja, mobile phones, ID cards, and ^11,500/- were seized from their possession in the presence of the Tahsildar and mediators. dv'

Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor submits that the investigation is not yet completed and some witnesses have to be examined. The arrested of Accused Nos.2 to 4 is also pending. Thus, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner. This Court is also not satisfied that there are reasonable grounds for believing that the petitioner is not guilty of the offence and that he is not likely to commit any offence while on bail. Hence, there are no merits in the criminal petition and it is liable to be dismissed. 5. more
